Latest FSSAI Changes – Position Effective from 1 April 2026

The Food Safety and Standards (Licensing and Registration of Food Businesses) Amendment Regulations, 2026 and the related turnover-threshold implementation order dated 13 March 2026 have significantly changed the FSSAI licensing and registration framework from 1 April 2026. Businesses should evaluate their FSSAI category under the revised regime rather than relying only on the older turnover limits.

Key Highlights of the Revised Framework

1. Revised Turnover Thresholds from 1 April 2026

FSSAI has revised the turnover-linked categorisation of food businesses. Broadly, the revised turnover structure is as follows:

  • Basic Registration – annual turnover up to ₹1.5 crore
  • State License – annual turnover above ₹1.5 crore and up to ₹50 crore
  • Central License – annual turnover above ₹50 crore

However, turnover is not the only deciding factor. The applicable FSSAI category also depends on the Kind of Business (KoB), manufacturing / processing capacity, storage capacity, importer / exporter status, premises category, and whether the business falls under a mandatory Central License class.

2. Perpetual Validity Framework Introduced

One of the most important changes under the 2026 amendment is the move toward a perpetual validity framework for applicable FSSAI registrations / licences issued or renewed under the revised regime. This means the approval may no longer follow the earlier fixed 1–5 year renewal model in the same manner for covered categories.

But perpetual validity does not mean one-time compliance. Food businesses must still ensure:

  • payment of applicable annual fee, where prescribed
  • annual return filing, where applicable
  • timely modification / update when business particulars change
  • continued compliance with hygiene, food safety, display, and category-specific obligations
  • response to departmental queries, inspections, or audits where required

So from a practical business perspective, FSSAI remains an ongoing compliance, not a one-time registration.

3. Street Vendors Registered Under the Street Vendors Act Get Deemed Registration Benefit

The amended framework also recognizes a deemed registration concept for certain street food vendors / hawkers / food carts / food trucks who are already registered under the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014, subject to the terms of the FSSAI amendment framework. This is a major ease-of-doing-business measure for the street-food segment.

4. Risk-Based Inspection and Compliance Monitoring

The 2026 changes strengthen the move toward risk-based inspection and audit mechanisms, under which inspection intensity may depend on factors such as:

  • nature of food business
  • risk profile of products handled

Types of FSSAI Approval Under the Revised 2026 Framework

FSSAI compliance broadly continues through three levels of approval:

1. FSSAI Basic Registration

Basic Registration is generally meant for petty food business operators / small food businesses falling within the prescribed threshold and category criteria.

Broad turnover threshold

Annual turnover up to ₹1.5 crore under the revised framework, subject to category-specific rules.

Important note

Even where turnover falls within the Basic Registration threshold, the business should still be checked for whether it falls into a category that requires a higher licence due to nature of activity, capacity, or other FSSAI rules.

2. FSSAI State License

State License is generally required for medium-scale food businesses or those that fall into a State licensing category under the revised FSSAI framework.

Broad turnover threshold

Annual turnover above ₹1.5 crore and up to ₹50 crore, subject to business category and other criteria.

Commonly suitable for:

  • restaurants / cafés beyond basic registration level
  • medium manufacturers / processors
  • food distributors / stockists / storage businesses
  • larger cloud kitchens
  • medium-scale food traders
  • businesses whose activity / capacity requires State licensing

3. FSSAI Central License

Central License is generally required for large food businesses, importers, and other businesses falling in specified Central-license categories.

Broad turnover threshold

Annual turnover above ₹50 crore, or any business falling in a mandatory Central License category irrespective of turnover.

Common cases where Central License may apply:

  • importers of food products
  • certain exporters / large food processors
  • businesses operating at airports, seaports, central government premises, or other notified categories
  • large manufacturers / storage / transport / repacking businesses depending on capacity and KoB
  • food businesses specifically falling under Central licensing criteria on FoSCoS

Important Note on FSSAI Thresholds

The revised turnover thresholds are important, but FSSAI classification is not determined by turnover alone. The correct FSSAI category must be decided after considering:

Deemed Registration for Certain Street Vendors

The 2026 amendment framework recognizes a special compliance benefit for certain street vendors already registered under the Street Vendors Act. Broadly, street food vendors / hawkers / food carts / food trucks holding a valid registration / certificate under the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 may be treated as deemed registered under the FSSAI framework, subject to the conditions of the amended regulations.

This is a significant development for the informal and micro food-business segment and should be evaluated carefully where applicable.

FSSAI Registration / License Process

Step 1 – Identify the correct FSSAI category

Step 6 – Grant of Registration / License

Upon approval, the FSSAI Registration Certificate / License is issued through FoSCoS.

FSSAI Modification / Amendment Services

Perpetual Validity vs Ongoing Compliance – Important Clarification

This is one of the most important practical points under the 2026 framework.

Earlier approach

FSSAI approvals were commonly taken for 1 to 5 years and renewed before expiry.

Revised approach

Under the revised framework, applicable registrations / licences may operate under a perpetual validity structure.

But businesses still need to track:

✔ annual fee obligations, where applicable
✔ annual return filing, where applicable
✔ modification when details change
✔ compliance with hygiene and food safety conditions
✔ response to inspection / audit / departmental queries

So “perpetual validity” should be understood as a change in validity structure, not a removal of compliance responsibilities.
